Terms of Service

By accessing or using Snipr ("the Service"), you agree to be bound by these Terms of Service.

If you do not agree to these Terms, you may not use the Service.

Snipr is a platform that allows users to:

• Track product listings
• Monitor price changes
• Receive notifications
• Configure automatic purchasing preferences
• Manage purchase history and saved payment methods

Snipr does not manufacture, own, or sell products listed on third-party marketplaces.

Snipr purchases items directly through its own marketplace account and arranges delivery to the address you provide. Snipr is the buyer of record on all transactions. You are purchasing the item from Snipr, not directly from the eBay seller.

By using Auto-Buy, you authorise Snipr to purchase the item on your behalf and charge your saved payment method for the item price plus any applicable service fee.

Prices displayed may not include applicable taxes. Snipr may collect and remit sales tax, VAT, or other applicable taxes where required by law. Any applicable tax will be disclosed at the time of purchase.

You are responsible for:

• Maintaining the security of your account
• Providing accurate information
• Restricting access to your account

You are responsible for all activity that occurs under your account.

By enabling Auto-Buy for a product, you authorize Snipr to attempt to purchase eligible listings on your behalf when your configured criteria are met.

You acknowledge that:

• Auto-Buy is optional.
• Auto-Buy may be disabled at any time.
• Purchase attempts are based on the preferences you configure.
• Listings are supplied by third-party marketplaces and sellers.

Snipr does not guarantee that:

• A product will be available.
• A purchase attempt will succeed.
• A listing will remain available.
• A product will remain at the displayed price.

Listings may change, expire, or become unavailable at any time.

Product prices, taxes, shipping costs, fees, availability, and listing details may change without notice by the marketplace or seller.

Snipr is not responsible for price changes, inventory changes, seller actions, or marketplace actions occurring outside of its control.

Snipr integrates with third-party marketplaces and services.

Your use of products, listings, or services offered through those platforms may also be governed by the terms and policies of those third parties.

Your use of Snipr may also be subject to eBay's User Agreement and applicable marketplace policies. By using Snipr, you confirm that your use complies with any applicable third-party platform terms.

Snipr is not responsible for the actions, products, services, content, or conduct of third-party sellers or marketplaces.

Users may be required to provide payment information in order to use certain features.

Payment processing is provided by third-party payment processors.

Snipr does not store full payment card information.

Snipr charges a per-purchase service fee on each completed Auto-Buy transaction. Users on a Snipr Premium subscription are not charged a per-purchase fee.

Fee amounts are disclosed within the app prior to activating Auto-Buy. Snipr reserves the right to update its fee structure with notice to users.

Refund eligibility is determined according to applicable law, marketplace policies, payment processor rules, and Snipr policies.

Snipr may refuse refunds where permitted by law in cases involving misuse, fraud, or abuse of the Service.

Because Snipr is the buyer of record, all disputes with eBay sellers are handled by Snipr on your behalf.

If you receive an item that is not as described, damaged, or not delivered, contact contact@getsnipr.app within 7 days of the estimated delivery date.

To the maximum extent permitted by law, Snipr shall not be liable for:

• Lost profits
• Lost opportunities
• Price fluctuations
• Missed deals
• Failed purchase attempts
• Third-party seller actions
• Marketplace outages
• Data inaccuracies

The Service is provided on an "as-is" and "as-available" basis.

Users may not:

• Violate any applicable laws
• Attempt unauthorized access
• Abuse the platform
• Interfere with the operation of the Service
• Use the Service for fraudulent purposes
• Use Snipr to purchase items for commercial resale or arbitrage
• Activate Auto-Buy on behalf of a third party without their explicit consent
• Circumvent or attempt to circumvent Snipr's fee structure
• Use Snipr in a way that violates eBay's User Agreement or Seller policies

Snipr may suspend or terminate accounts that violate these Terms.

Snipr may modify these Terms at any time.

Continued use of the Service constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any disputes arising from these Terms shall be resolved through binding arbitration under the rules of the American Arbitration Association, except where prohibited by law.

Nothing in this clause prevents either party from seeking injunctive relief in a court of competent jurisdiction.
